User Agreement

This User Agreement ("Agreement") governs the relationship between Austin Credit Doctors LLC ("we," "us," or "our"), a Texas-based credit repair organization, and you, the client ("you" or "your"), regarding the credit repair and related services we provide.

By engaging our services, you agree to be bound by the terms of this Agreement, which complies with the Credit Repair Organizations Act (CROA), the Fair Credit Reporting Act (FCRA), the Gramm-Leach-Bliley Act (GLBA), and applicable Texas state laws.

Our services may involve third-party providers, including Mixo.io (website hosting), IdentityIQ (credit monitoring), Rent Reporters (rental payment reporting), and Dispute Composer (dispute letter generation).

This Agreement outlines your rights, responsibilities, and the scope of our services.

1.Scope of Services Austin Credit Doctors LLC provides credit repair services, which may include: Reviewing your credit reports from consumer reporting agencies (e.g., Equifax, Experian, TransUnion) via IdentityIQ. Identifying inaccurate, incomplete, or unverifiable information on your credit reports. Preparing and sending dispute letters to consumer reporting agencies using Dispute Composer. Reporting rental payment history to credit bureaus through Rent Reporters to support credit-building efforts. Providing credit education and guidance to help you improve your credit profile. We operate our website through Mixo.io, which may collect usage data to enhance your online experience.

Limitations:
We cannot guarantee specific outcomes, such as credit score improvements or removal of accurate negative information, as prohibited by CROA. Our services are limited to disputing inaccuracies and providing education, as permitted by the FCRA.

2. Your Responsibilities As a client, you agree to: Provide accurate and complete information, including personal details, financial records, and credit-related documentation. Promptly notify us of any changes to your contact or payment information. Review and respond to communications from us, including dispute letters and credit report updates. Pay all fees as outlined in Section 5 (Fees and Payment). Comply with all applicable laws and this Agreement.

3. Your Rights Under CROA and FCRA Under the Credit Repair Organizations Act (CROA), you have the following rights: Right to Disclosure: You will receive a separate "Consumer Credit File Rights Under State and Federal Law" disclosure before signing this Agreement, as required by 15 U.S.C. § 1679c.
Right to Cancel: You may cancel this Agreement within three (3) business days of signing without penalty or obligation by providing written notice to us at the contact information above (15 U.S.C. § 1679b). Right to Truthful Information: We will not make false or misleading claims about our ability to improve your credit, as prohibited by 15 U.S.C. § 1679b. Right to Sue: You may file a lawsuit for CROA violations within five years, as provided by 15 U.S.C. § 1679g. Under the Fair Credit Reporting Act (FCRA), you have the right to: Obtain free annual credit reports from consumer reporting agencies. Dispute inaccurate or incomplete information directly with consumer reporting agencies. Be informed if your information is used for adverse actions, such as credit denials.

4. Information Collection and Sharing We collect and share your nonpublic personal information (NPI) as described in our Privacy Policy, which is incorporated into this Agreement. In summary: Collection: We collect personal details (e.g., name, Social Security number), financial information, and credit data you provide or we obtain through IdentityIQ, Rent Reporters, or Dispute Composer. Sharing: We share your information with: Affiliated Providers: IdentityIQ, Rent Reporters, Dispute Composer, and Mixo.io to deliver services. Nonaffiliated Third Parties: Consumer reporting agencies, payment processors, or legal authorities, as permitted by the FCRA and GLBA Section 15 exceptions. Joint Marketing Partners: Limited sharing for service delivery, as allowed under GLBA Section 13, with safeguards. Opt-Out: You may opt out of certain nonaffiliated third-party sharing by contacting us, as outlined in our Privacy Policy. We comply with Texas data protection laws, including the Texas Identity Theft Enforcement and Protection Act, and will notify you of any data breach as required.

5. Fees and Payment Fee Structure: Our fees are disclosed in a separate contract or service plan provided before services begin, as required by CROA. Fees may include setup costs, monthly charges, or per-service fees. Payment Terms: You agree to pay all fees via [Insert Payment Methods, e.g., credit card, ACH]. Payments are due as outlined in your service plan. No Advance Fees: In compliance with CROA and Texas law, we will not charge fees for services until they are fully performed (15 U.S.C. § 1679b).

Refunds: Refunds are available only within the three-day cancellation period or as required by law. No refunds will be issued for services already performed.

6. Termination By You: You may terminate this Agreement at any time after the three-day cancellation period by providing written notice. You remain responsible for fees for services performed prior to termination.
By Us:
We may terminate this Agreement if you fail to pay fees, provide false information, or breach this Agreement. We will provide written notice and comply with CROA requirements. Effect of Termination: Upon termination, we will cease all services, and you will no longer have access to our third-party tools (e.g., IdentityIQ, Dispute Composer).

7. Confidentiality and Security We maintain reasonable safeguards to protect your NPI, including encryption, access controls, and secure third-party platforms. However, no system is completely secure, and we are not liable for unauthorized access beyond our control, except as required by law.

8. Compliance with Texas State Laws As a Texas-based business, we comply with the Texas Business and Commerce Code, Chapter 20, which regulates credit repair organizations. This includes: Registering with the Texas Secretary of State, if required. Providing clear disclosures and contracts. Adhering to restrictions on fees and misleading claims. You may contact the Texas Office of Consumer Credit Commissioner or the Texas Attorney General for information on your rights or to file a complaint.

9. Limitation of Liability To the fullest extent permitted by law, Austin Credit Doctors LLC is not liable for: Indirect, incidental, or consequential damages arising from our services. Outcomes beyond our control, such as credit score changes or third-party decisions by consumer reporting agencies. Errors or omissions by third-party providers (e.g., IdentityIQ, Rent Reporters, Dispute Composer, Mixo.io), except as required by law. Our liability is limited to the amount you paid for our services, as permitted by Texas law.

10. Dispute Resolution Any disputes arising under this Agreement will be resolved as follows: Informal Resolution: Contact us to resolve issues informally within 30 days. Governing Law: This Agreement is governed by Texas law and applicable federal laws (CROA, FCRA, GLBA). Venue: Any legal action must be filed in a court of competent jurisdiction in [Insert County, e.g., Travis County], Texas. CROA Claims: You may pursue CROA violations in federal or state court, as provided by 15 U.S.C. § 1679g.

11. Amendments We may amend this Agreement by providing written notice (e.g., via email or our website). Continued use of our services after amendments constitutes acceptance of the updated terms.

12. Entire Agreement This Agreement, along with our Privacy Policy and any signed service contracts, constitutes the entire agreement between you and Austin Credit Doctors LLC.

It supersedes all prior agreements or understandings.

Generate and manage dispute letters using Dispute Composer. Operate and improve our website, hosted by Mixo.io, including personalization and analytics. Process payments and manage billing.
